These Testnet Faucet Terms and Conditions (the “Faucet Terms”) constitute an addendum to the General Terms and Conditions for the provisions of and use of Paxos’ testnet faucet and associated free testnet faucet funds (the “Testnet Faucet”) and is a binding legal agreement between you (“you” or “your”) and Paxos. These terms apply to each electronic form or contract executed by users and/or members who use the Testnet Faucet, unless expressly stipulated otherwise in the Paxos Contractual Documentation. To the extent there is a conflict between the Faucet Terms and the General Terms and Conditions, the Faucet Terms shall govern and control with respect to the Testnet Faucet. Capitalized terms not otherwise defined herein shall have the meaning ascribed to them in the General Terms and Conditions.

Testnet Faucet
The Testnet Faucet provides you with access to test tokens that are not real and hold no intrinsic value. These tokens are distributed free of charge and are intended solely for use within the Testnet Faucet as a means for you to test and explore functionalities and use cases in a simulated environment. It is important to understand that these test tokens cannot be exchanged for real currency, assets, or any form of valuable consideration, nor do they represent any stake, share, or financial interest in any project or entity. You should be aware that the Testnet Faucet and its test tokens are subject to resets and changes at the discretion of Paxos, which may result in the loss of test tokens without recourse. By accessing and using the Testnet Faucet, you agree to utilize these test tokens exclusively for testing purposes and you acknowledge that these test tokens are purely symbolic, devoid of value, and not intended for real-world transactions.

Acceptable Use
You are responsible for any activity carried out through the Testnet Faucet. You will comply with any applicable federal, state, and local laws, statutes, and regulations, and all applicable orders, judgments, decisions, rules, policies, opinions, attorney general opinions, or guidelines passed or issued by any regulatory authority or any competent court, including privacy laws, sanctions, anti-corruption laws including rules or requirements, and all foreign laws regarding the same (“Laws”), relating to these Faucet Terms, as the same may be amended and in effect from time to time.

Maintenance and Termination of Access
Paxos does not offer or guarantee any availability in the operation of the Testnet Faucet. Paxos may suspend, terminate or revoke your access to and use of the Testnet Faucet at any time with or without prior notice to you if, : (i) Paxos suspects or is aware of your breach of the provisions of these Faucet Terms or the General Terms and Conditions; (ii) you violate any applicable Law(s); (iii) it is advisable or necessary for Paxos to comply with Laws; or (iv) for any other reason in our sole and absolute discretion. In addition, we may discontinue or cease operations of the Testnet Faucet at any time, without prior notice to you. Upon termination for any reason, you must immediately cease the use of the Testnet Faucet.

Limitation on Liability
THE TESTNET FAUCET IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY EXPRESS OR IMPLIED WARRANTY OF ANY KIND INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE INCLUDING THAT THE SERVICES HEREUNDER WILL BE UNINTERRUPTED OR ERROR-FREE. IN NO EVENT SHALL WE BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION) ARISING OUT OF THE USE OF OR INABILITY TO USE THE TESTNET FAUCET, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE TESTNET FAUCET MAY NOT OPERATE ACCURATELY AND MAY BE SUBSTANTIALLY MODIFIED PRIOR TO PUBLIC AVAILABILITY OR WITHDRAWN AT ANY TIME. ACCORDINGLY, ACCESS TO AND USE OF THE TESTNET FAUCET IS ENTIRELY AT YOUR OWN RISK.

Privacy Policy
For the avoidance of doubt, Paxos’s Privacy Policy applies to your use of the Testnet Faucet.

Indemnity

You agree to indemnify and hold Paxos, its officers, directors, and employees harmless from any losses (including attorneys’ fees) that result from any third-party claims related to your access, use, or misuse of the Testnet Faucet, or any act or omission by you in violation of these Faucet Terms.
